The first step in making a GP negligence claim is to prove that the doctor was negligent. In order to do this, you must be able to show that:

The doctor failed to act in accordance with the standards of practice in Ireland; and
As a result of this failure, you suffered an injury or illness.

You’ll also need to prove that your injury was caused by their negligence and occurred while they were treating you as their patient (or within 12 months after leaving their care). For example, if someone suffers an injury after going home from hospital following surgery performed by one of our surgeons but without complications during surgery or afterwards–and then suffers further complications at home–we will not accept any liability for those additional injuries since they were outside our control and beyond our knowledge at the time we treated him/her directly under our supervision as part of his/her initial treatment plan which included post-operative care instructions given verbally by him/herself over several days following discharge from hospital into his own home environment.”
